OpEd: Will Supreme Court Outlaw mandatory car insurance?

In areas of public interest, where the theory of large numbers requires a large number of participants, states have routinely held that citizens must obtain car insurance in order to validly drive an automobile. If one would conclude from the Supreme Courts arguments today that a nation cannot insist in the matter of public health and safety of insisting on health insurance being obtained either through a pool, or individually, then one wonders whether mandatory auto insurance will be next... or taxes themselves... Why should I be required to pay taxes...or eat brocolli....or wear a helmet....Maybe the Supreme Court can set a standard so broad that it will make collecting taxes impossible and thus reduce the size of government and create anarchy to the complete delight of the fundamentalist brethern....Alleluia.

    Like our own state supreme court, the U.S. Supreme Court has sadly succumbed to politics. One only need refer to BUSH v. GORE (where the Court was so ashamed of what they did, they actually wrote that the opinion could never be used as precedent in the future) and CITIZENS UNITED (the most intellectually dishonest opinion I've seen in my 20 years as a lawyer). As such, I'm not expecting anything close to constitutional scholarship. I do NOT believe the mandate is constitutional, even though it is for a necessary purpose. (I'm scared to death what an R congress, along with an R president would do with that authority in the future.) Too bad we can't just do Medicare for all and be done with it. It's disgusting that our country allows corporations to profit off of those sick and dying.

  2. I truly believe if you can not afford car insurance you should not be driving. Liability insurance is very cheap and that is the very least people should be required to have. It is because of people with out insurance our rates are what they are.
